Terms of Service

These terms govern your use of the Where Is The Sun mobile application and the website at whereisthesun.app (together, the "service"). By downloading, installing, or using the service, you agree to these terms. If you do not agree, do not use the service.

1. The service

Where Is The Sun is a utility that calculates the position of the sun and moon for your current location and any date you select, and displays that information on top of your camera feed. The service is provided as an informational tool to help you understand sunlight patterns at a given place and time.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your personal or internal business use. You may not copy, modify, reverse-engineer, decompile, disassemble, or distribute the app, except to the limited extent that applicable law expressly permits despite this restriction.

3. No professional advice

The service provides astronomical data and visualizations. It is not professional advice on real estate, architecture, engineering, solar energy, agriculture, or any other field. Sun paths shown in the app represent idealized astronomical positions and do not account for trees, buildings, clouds, atmospheric conditions at a specific moment, or any other real-world obstructions. Do not rely on the service as the sole basis for a purchase, construction, or investment decision. Always consult a qualified professional.

4. Accuracy

The app uses Jean Meeus's astronomical algorithms, which are accurate to within a few arc-minutes for sun position under ideal conditions. Real-world accuracy depends on your device's GPS, compass calibration, and sensor quality, as well as magnetic interference from nearby metal and electronics. We make reasonable efforts to surface sensor-quality warnings in the app, but we do not guarantee any specific level of accuracy in your environment.

5. Your content and conduct

The app does not collect or host user content. You agree not to use the service for any unlawful purpose, not to interfere with the app's operation, and not to attempt to gain unauthorized access to any systems or networks.

6. Intellectual property

The app, website, logos, text, graphics, icons, and source code are owned by us or our licensors and are protected by copyright, trademark, and other intellectual-property laws. These terms do not grant you any rights to our trademarks or trade dress.

7. Third-party services

The app is distributed through the Apple App Store and Google Play. Those platforms have their own terms that also apply to your use of the app. Your device's operating system vendor may also govern your access to camera, location, and sensor APIs.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR PRODUCE ANY SPECIFIC RESULT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR TEN U.S. DOLLARS, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the service or violation of these terms.

11. Changes

We may update these terms from time to time. If we make material changes, we will post the updated terms at this URL and update the "Last updated" date. Your continued use of the service after changes take effect constitutes your acceptance of the revised terms.

12. Termination

You may stop using the service at any time by uninstalling the app. We may suspend or terminate access to the service, for any reason, at any time, subject to applicable law.

13. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute arising from these terms or the service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
